Separation and divorce: Financial issues and orders
When the court grants and order of divorce or judicial separation, it will usually make a number of other related orders to do with finance, assets and any property that exists.
When it is deciding on orders related to finance and property, the court must ensure that proper provision has been made for both spouses and any dependent children.
The most usual orders made are for:
- Maintenance,
- Ownership of the family home,
- Ownership of any other property, assets or shares where they exist,
- Occupation of the family home (who will go, and who will stay),
- Pensions owned
- Succession/inheritance rights.
